Information from a student’s education record may be shared within BW only among appropriate school officials having legitimate educational interests in the records. Disclosure of Education Records: A student has the right to consent for disclosure of personally identifiable information in education records, except to the extent that the Act or any superseding law authorizes disclosure without student consent.Request for Amendment of Education Records: A student has the right to request amendment of education records if the student believes they are inaccurate, misleading, or in violation of privacy rights under the Act.BW will provide access to the education records within 45 days of a request. Access to Education Records: After matriculating to Baldwin Wallace University (BW), an eligible student has the right to inspect and review their education records.Note: Definitions of the italicized key terms can be found in the key terms tab below. FERPA allows the following student rights with respect to education records. Under FERPA, prior written consent must be obtained before a student’s education record may be disclosed to a third party, unless they are exempted from this provision.The Family Educational Rights and Privacy Act (FERPA) is a federal law that governs the collection, protection, and disclosure of students' education records. Appropriate school officials who have legitimate educational interests (see definition of “school official” on next page).Private Records may be released only to the following parties: The following categories of information are considered private or protected, by UTSA: The University may disclose research papers and theses authored by the student to interested members of the public. Students wishing to restrict access to some or all public information in their education record must do so through the FERPA/Proxy option on ASAP. Regardless of the effect upon a student, the university assumes no liability for honoring a student’s request that such information is withheld. UTSA will honor a student’s request to withhold any of the items of public records information listed, but cannot assume responsibility to contact a student for subsequent permission to release the information.
